2.- How do we obtain your personal data?
At Sp-Berner we collect your personal data primarily when:
- The user provides them voluntarily to request information about our products and services (i) by contacting us through www.sp-berner.com, and its subdomains (hereinafter website), our telephone number, or (ii) by registering in the forms that can be found in the account/s you have created on the various social networks.
- You give them to us when you contract our services.
- You download free content offered by Sp-Berner on the website and/or participate in any advertising or promotional action/event organised/coordinated/sponsored by Sp-Berner, including events managed through a specific site.
- You subscribe to our Newsletter.
The user guarantees that the data provided by any of these means are true, exact, complete and current. The user is responsible for any damage or harm, direct or indirect, that may be caused as a consequence of non-compliance with this obligation.
3.- Purpose
The website user’s personal data will be processed for the following purposes:
- To formalise a contractual relationship with Sp-Berner by contracting its products and services.
- To respond to information requests and/or queries made by the user. The data processed for this purpose will be stored until the request for information and/or query has been answered.

4.- Legitimation
The legal basis for each of the above procedures is as follows:
a) “Execution of contracts:” this is the legal basis that enables us to carry out the following processing of your personal data:
- To follow up and manage user enquiries submitted to us by any means (our website, by telephone, via social networks, etc.) such as: request for Newsletter subscription or downloading of free content offered by Sp-Berner, registration and/or participation in activities, advertising/promotional events organised by Sp-Berner.
- To formalise a service provision contract.
b) “Compliance with legal obligations”: This is the legal basis that enables us to carry out the following processing of your personal data:
- To respond to the demands of Public Administrations, Judicial Agencies and State Security Forces.

5.- Addressees
The data may be communicated to the following third party recipients: Public Administrations in order to comply with legal obligations and banks to manage collections and payments. The data may also be communicated to the following categories of data processors: providers of electronic communications, office automation, hosting, housing, computer maintenance, management, accounting, auditing, consultancy and legal representation. These processors may be located in the United States and adhered to Privacy Shield – Commission Decision (EU) 2016/1250 of 12 July 2016.
6.- How long will we keep your data?
Your personal data will be stored by Sp-Berner for the time that is necessary to fulfil the purpose for which it was collected.
- If your data is used for more than one purpose which requires us to keep it for different periods of time, we will apply the longest retention period. In that case we will limit access to your data to the purpose for which it is being stored.
- If your personal data is used for purposes for which the legitimate basis is your consent, we will keep your data active until your consent is revoked, or until you exercise your rights of deletion or objection to the processing. We will keep your data until an earlier date if we consider that they are no longer necessary for carrying out commercial activities, either because they are no longer appropriate, relevant or current.
- If your personal data is used for purposes for which the legitimate basis is the execution of a contract, we will keep your data active for the duration of the contractual relationship and for a maximum of 10 years after the contractual relationship has ended.
- If your personal data is used for purposes for which the legitimate basis is compliance with legal obligations, we will keep your data for the periods required by the specific applicable regulations (tax, commercial, money laundering, protection of personal data, etc.).
- If your personal data is used for legitimate interest purposes, we will keep your data active for as long as we maintain our legitimate interest.
7.- Rights
The user may exercise the following rights regarding Sp-berner’s policies:
- The right to access all personal information to know which data are being used and the methods and/or operations involved in their processing.
- The right to modify any incorrect personal information.
- The right to delete any personal data if possible.
- The right to request the restriction of processing of your personal data when the accuracy, lawfulness or necessity of such processing is in doubt. In this case, we may retain the data for the purpose of asserting or defending claims.
- The right to transfer your personal data, where the legal basis for its processing as set out in paragraph 4 above, includes the contractual relationship or consent.
- The right to object to the processing of your personal data, where the lawful basis which enables us to process your personal data as set out in paragraph 4 above includes legitimate interest. For these purposes, we will stop processing your data unless we have a compelling legitimate interest or for the formulation, exercise or defence of claims.
- The right to withdraw your consent at any time.
Similarly, where the processing of user data is based on the user’s consent, the user has the right to withdraw such consent at any time. This does not affect the lawfulness of the processing based on the consent prior to its withdrawal.
